Terms and Conditions 

  1. Scope 1.1 These Terms and Conditions of Cute Treasures ("Seller") apply to all contracts for the supply of goods that a consumer or business ("Customer") concludes with the Seller regarding goods displayed in the Seller’s online store. The inclusion of the Customer's own terms is hereby rejected unless otherwise agreed. 1.2 A "consumer" within the meaning of these AGB is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activity. A "business" is a natural or legal person or partnership with legal capacity acting in exercise of their commercial or independent professional activity when entering into a legal transaction. 1.3 The contract may involve a one-time delivery of goods or a subscription ("Subscription Contract") depending on the Seller’s product description. For subscription contracts, the Seller is obligated to provide the contractual goods for the agreed term at the specified intervals.

Incorrect Address Provided by Buyer:
If the Buyer provides an incorrect address for an order, the Seller is not obliged to refund the amount until the package is returned to us. However, we offer a redirection to the correct address; please contact us via email.

  1. Conclusion of Contract 2.1 Product descriptions in the Seller's online store do not constitute binding offers from the Seller but are invitations for the Customer to submit a binding offer. 2.2 The Customer submits an offer via the online order form integrated into the Seller's online store. After adding selected goods to the virtual shopping cart and completing the electronic ordering process, the Customer makes a legally binding offer for the goods in the shopping cart by clicking the button that completes the order. 2.3 The Seller may accept the Customer's offer within five days:
    • by sending the Customer a written order confirmation or an order confirmation in text form (fax or email), with receipt of the confirmation being decisive, or
    • by delivering the ordered goods to the Customer, with receipt of the goods being decisive, or
    • by requesting payment from the Customer.

The contract is concluded at the time when one of these alternatives occurs first. The acceptance period begins the day after the Customer’s offer is sent and ends at the end of the fifth day following the offer’s submission. If the Seller does not accept the Customer’s offer within this period, the offer is deemed rejected, and the Customer is no longer bound by their declaration of intent. 2.4 When selecting "PayPal Express," payment processing is handled by PayPal (Europe) S.à r.l. et Cie, S.C.A., under PayPal’s terms. By selecting "PayPal Express" as the payment method, the Customer initiates a payment order to PayPal by clicking the final order button. The Seller accepts the Customer’s offer at the moment the payment transaction is triggered. 2.5 When selecting "Amazon Payments," payment processing is handled by Amazon Payments Europe s.c.a., under the Amazon Payments Europe User Agreement. By selecting "Amazon Payments" as the payment method, the Customer initiates a payment order to Amazon by clicking the final order button. The Seller accepts the Customer’s offer at the moment the payment transaction is triggered. 2.6 When placing an order via the online order form, the Seller stores the contract text and sends it to the Customer along with these AGB via email. The Customer cannot access the contract text online after submitting the order. 2.7 Before submitting the binding order, the Customer can identify input errors by carefully reading the information displayed on the screen. Magnification features in the browser can assist in recognizing errors. The Customer may correct input until clicking the final order button. 2.8 The only available language for concluding the contract is English. 2.9 Order processing and contact typically occur via email and automated order processing. The Customer must ensure that the email address provided for order processing is correct and capable of receiving emails from the Seller.

  1. Right of Withdrawal 3.1 Consumers generally have a statutory right of withdrawal if items are faulty or damaged. 3.2 Further information on the right of withdrawal can be found in the Seller's cancellation policy.

  2. Prices, Currencies, and Payment Terms 4.1 Unless otherwise indicated, prices listed by the Seller are total prices in Euro (€), including statutory VAT. Any additional shipping costs are specified in the respective product description. Customers may have the option to view prices in other currencies based on their location; however, the final payment will be processed in Euros unless otherwise specified. 4.2 For deliveries outside the EU, additional costs may apply, which the Seller is not responsible for and must be borne by the Customer (e.g., bank transfer fees or customs duties). 4.3 Payment methods are specified in the Seller’s online store. 4.4 For payments via PayPal, processing occurs under PayPal's terms, accessible here. 4.5 For payments via SOFORT, processing is done through SOFORT GmbH. Payment via SOFORT requires an online banking account enabled for SOFORT, and the Customer must confirm payment to SOFORT directly. 4.6 Credit card payments are processed with secupay AG. The invoice amount is debited from the Customer’s credit card upon order submission.

  3. Delivery and Shipping Terms 5.1 Goods are shipped to the address provided by the Customer unless otherwise agreed. For orders placed through PayPal, the delivery address stored with PayPal is decisive. 5.2 If the transport company returns the goods to the Seller because delivery to the Customer was unsuccessful, the Customer bears the cost of the unsuccessful shipment, unless they are not responsible for the failed delivery. 5.3 Self-pickup is not possible. 5.4 In cases of refusal to accept the package, the Seller reserves the right to retain 30% of the purchase price due to logistical costs. 70% of the purchase price will be refunded.

  4. Contract Duration and Termination for Subscription Contracts 6.1 Subscription contracts are concluded for an indefinite period and may be terminated by the Customer at the end of each month. 6.2 The right to extraordinary termination for good cause remains unaffected. 6.3 Terminations must be made in writing or text form (e.g., via email).

  5. Retention of Title The Seller retains ownership of the goods until full payment of the purchase price is received.

  6. Liability for Defects 8.1 In the event of defects, statutory liability for defects applies. 8.2 For used goods, claims for defects arising one year after delivery are excluded, except in cases of fraud, malicious nondisclosure of defects, or damage claims due to injury or gross negligence.

  7. Redemption of Promotional Vouchers 9.1 Vouchers issued by the Seller in promotional campaigns are redeemable only in the Seller’s online store and within the specified timeframe. 9.2 Vouchers cannot be purchased and may not be exchanged for cash.

  8. Applicable Law The law of the Federal Republic of Germany applies to all legal relationships, excluding laws on the international sale of goods. For consumers, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory consumer protection laws in the consumer’s country of residence.

  9. Alternative Dispute Resolution 11.1 The EU Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

  10. Refund Policy Orders cannot be changed or canceled once placed, as processing begins immediately. Customers may contact us to request returns.

  • Return Shipping Costs: Borne by the Customer.
  • Refund Timeframe: Within 14 days of receipt of the returned item in the original condition.
  1. International Shipping Conditions and Customs Duties For international orders, additional customs fees or duties may apply based on the destination country's regulations. These charges are the responsibility of the Customer and may vary by country.

Allgemeine Geschäftsbedingungen (AGB)

  1. Geltungsbereich
    1.1 Diese Allgemeinen Geschäftsbedingungen ("AGB") von Cute Treasures ("Verkäufer") gelten für alle Verträge über die Lieferung von Waren, die ein Verbraucher oder Unternehmer ("Kunde") mit dem Verkäufer hinsichtlich der im Online-Shop des Verkäufers dargestellten Waren abschließt. Die Einbeziehung von eigenen Bedingungen des Kunden wird hiermit widersprochen, es sei denn, es ist etwas anderes vereinbart.
    1.2 Ein "Verbraucher" im Sinne dieser AGB ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbstständigen beruflichen Tätigkeit zugerechnet werden können. Ein "Unternehmer" ist eine natürliche oder juristische Person oder eine rechtsfähige Personengesellschaft, die beim Abschluss eines Rechtsgeschäfts in Ausübung ihrer gewerblichen oder selbstständigen beruflichen Tätigkeit handelt.
    1.3 Der Vertrag kann – je nach Produktbeschreibung des Verkäufers – eine einmalige Lieferung oder eine wiederkehrende Lieferung von Waren (nachfolgend „Abonnementvertrag“) betreffen. Bei Abonnementverträgen verpflichtet sich der Verkäufer, dem Kunden die vertraglich geschuldete Ware für die Dauer der vereinbarten Vertragslaufzeit in den festgelegten Zeitintervallen zu liefern.

Falsche Adressangabe durch den Käufer:
Falls der Käufer eine falsche Adresse angibt, ist der Verkäufer nicht verpflichtet, den Betrag zu erstatten, bis das Paket zurückgeschickt wurde. Der Verkäufer bietet jedoch eine Umleitung an die korrekte Adresse an. Bitte kontaktieren Sie uns dazu per E-Mail.

  1. Vertragsschluss
    2.1 Die Produktbeschreibungen im Online-Shop des Verkäufers stellen keine verbindlichen Angebote dar, sondern dienen zur Abgabe eines verbindlichen Angebots durch den Kunden.
    2.2 Der Kunde kann ein Angebot über das Online-Bestellformular des Verkäufers abgeben, indem er die ausgewählten Waren in den Warenkorb legt und den elektronischen Bestellvorgang durchläuft. Durch Klicken des Buttons, der den Bestellvorgang abschließt, gibt der Kunde ein rechtlich verbindliches Vertragsangebot ab.
    2.3 Der Verkäufer kann das Angebot des Kunden innerhalb von fünf Tagen annehmen:
  • durch Übermittlung einer schriftlichen Auftragsbestätigung oder einer Bestätigung in Textform (z. B. per E-Mail),
  • durch Lieferung der bestellten Ware, oder
  • durch Aufforderung zur Zahlung.

Der Vertrag kommt in dem Moment zustande, in dem eine dieser Alternativen zuerst eintritt. Die Frist zur Annahme des Angebots beginnt am Tag nach Absenden des Angebots durch den Kunden und endet mit dem Ablauf des fünften Tages. Nimmt der Verkäufer das Angebot nicht innerhalb dieser Frist an, gilt es als abgelehnt.
2.4 Wählt der Kunde "PayPal Express", erfolgt die Zahlungsabwicklung über PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxemburg. Durch Auswahl dieser Zahlungsart gibt der Kunde einen Zahlungsauftrag an PayPal. Der Verkäufer nimmt das Angebot des Kunden an, sobald der Zahlungsvorgang ausgelöst wird.
2.5 Bei Auswahl von "Amazon Payments" erfolgt die Zahlungsabwicklung über Amazon Payments Europe s.c.a., Luxemburg. Durch Auswahl dieser Zahlungsart gibt der Kunde einen Zahlungsauftrag an Amazon. Der Verkäufer nimmt das Angebot des Kunden an, sobald der Zahlungsvorgang ausgelöst wird.
2.6 Der Vertragstext wird gespeichert und dem Kunden nach Absendung der Bestellung mit den AGB per E-Mail zugeschickt. Der Vertragstext ist nach Bestellung nicht mehr über die Website abrufbar.
2.7 Vor Abgabe der Bestellung kann der Kunde Eingabefehler durch sorgfältiges Lesen der Angaben erkennen und korrigieren. Die Vergrößerungsfunktion des Browsers kann hilfreich sein.
2.8 Vertragssprache ist ausschließlich Englisch.
2.9 Die Bestellabwicklung und Kontaktaufnahme erfolgen in der Regel per E-Mail und automatisierter Bestellabwicklung. Der Kunde hat sicherzustellen, dass die angegebene E-Mail-Adresse korrekt ist.

  1. Widerrufsrecht
    3.1 Verbrauchern steht grundsätzlich ein Widerrufsrecht zu bei beschädigten Artikeln.
    3.2 Weitere Informationen zum Widerrufsrecht ergeben sich aus der Widerrufsbelehrung des Verkäufers.

  2. Preise, Währungen und Zahlungsbedingungen
    4.1 Sofern nichts anderes angegeben ist, sind die Preise in Euro (€) angegeben und verstehen sich inklusive der gesetzlichen Umsatzsteuer. Möglicherweise kann der Kunde Preise in anderen Währungen sehen; die Abrechnung erfolgt jedoch, sofern nicht anders angegeben, in Euro.
    4.2 Für Lieferungen außerhalb der EU können zusätzliche Kosten anfallen (z.B. Überweisungsgebühren oder Zölle), die vom Kunden zu tragen sind.
    4.3 Die verfügbaren Zahlungsmethoden sind im Online-Shop des Verkäufers angegeben.
    4.4 Zahlungen über PayPal erfolgen gemäß den PayPal-Bedingungen, die hier abrufbar sind.
    4.5 Bei der Auswahl von "SOFORT" erfolgt die Zahlungsabwicklung über SOFORT GmbH. Der Kunde muss über ein für "SOFORT" freigeschaltetes Online-Banking-Konto verfügen.
    4.6 Kreditkartenzahlungen werden über die secupay AG abgewickelt. Der Rechnungsbetrag wird bei Bestellabschluss belastet.

  3. Liefer- und Versandbedingungen
    5.1 Die Lieferung erfolgt an die angegebene Adresse. Bei PayPal-Zahlungen ist die bei PayPal hinterlegte Adresse maßgeblich.
    5.2 Sendet das Transportunternehmen die Ware an den Verkäufer zurück, da eine Zustellung nicht möglich war, trägt der Kunde die Kosten des erfolglosen Versands, außer er hat die Zustellbarkeit nicht zu vertreten.
    5.3 Selbstabholung ist aus logistischen Gründen nicht möglich.
    5.4 Verweigert der Kunde die Annahme des Pakets, behält sich der Verkäufer das Recht vor, 30 % des Kaufpreises aufgrund logistischer Kosten einzubehalten. 70 % des Kaufpreises werden erstattet.

  4. Vertragsdauer und Kündigung bei Abonnementverträgen
    6.1 Abonnementverträge werden auf unbestimmte Zeit geschlossen und können vom Kunden monatlich gekündigt werden.
    6.2 Das Recht zur außerordentlichen Kündigung bleibt unberührt.
    6.3 Kündigungen müssen schriftlich oder in Textform (z. B. per E-Mail) erfolgen.

  5. Eigentumsvorbehalt
    Der Verkäufer behält sich das Eigentum an der Ware bis zur vollständigen Zahlung vor.

  6. Haftung für Mängel
    8.1 Bei Mängeln gelten die gesetzlichen Vorschriften.
    8.2 Bei gebrauchten Waren verjähren Mängelansprüche innerhalb eines Jahres nach Ablieferung, es sei denn, der Verkäufer hat den Mangel arglistig verschwiegen.

  7. Einlösung von Aktionsgutscheinen
    9.1 Aktionsgutscheine sind nur im Online-Shop des Verkäufers und nur im angegebenen Zeitraum einlösbar.
    9.2 Gutscheine sind nicht käuflich erwerbbar und nicht in bar auszahlbar.

  8. Anwendbares Recht
    Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. Bei Verbrauchern gilt diese Rechtswahl nur, sofern der gewährte Schutz nicht durch zwingende Bestimmungen des Staates des gewöhnlichen Aufenthalts des Verbrauchers entzogen wird.

  9. Alternative Streitbeilegung
    11.1 Die EU-Kommission stellt unter https://ec.europa.eu/consumers/odr eine Plattform zur Online-Streitbeilegung bereit.

  10. Rückerstattungsrichtlinie
    Bestellungen können nach Abschluss nicht geändert oder storniert werden. Kunden können uns jedoch für Rücksendungen kontaktieren.

  • Rücksendekosten: Diese trägt der Kunde.
  • Rückerstattungszeitraum: Innerhalb von 14 Tagen nach Erhalt der zurückgesendeten Ware im Originalzustand.
  1. Internationale Versandbedingungen und Zollgebühren
    Für internationale Bestellungen können je nach Zielland zusätzliche Zollgebühren oder Einfuhrabgaben anfallen. Diese Kosten sind vom Kunden zu tragen.
